The surgeon who performs any implant procedure is responsible for determining and utilizing the appropriate techniques for implanting a prosthesis in the particular patient. Wright is not responsible for the selection of the appropriate surgical technique to be used for an individual patient. Questions regarding the appropriateness of a particular technique or device should be directed to the individual patient’s physician. Wright does not promote or endorse in any way the use of a surgical technique which is not approved for use in the country where the reader is located.

Limitations of Liability
UNDER NO CIRCUMSTANCES, SHALL WRIGHT, OR ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, LICENSORS AND SERVICE PROVIDERS, OR ANY OF ITS OR THEIR RESPECTIVE SHAREHOLDERS, DIRECTORS, OFFICERS, EMPLOYEES OR AGENTS (COLLECTIVELY, THE “RELEASED PARTIES”), BE LIABLE TO YOU OR ANY THIRD PARTY CLAIMING THROUGH YOU FOR ANY LOSSES OR DAMAGES ARISING OUT OF OR IN CONNECTION WITH THESE SITES, THEIR CONTENT, ANY SERVICES OR PRODUCTS MADE AVAILABLE THROUGH THESE SITES, OR YOUR USE OF OR INABILITY TO USE THESE SITES, INCLUDING ANY LOSS OR DAMAGE DUE TO VIRUSES THAT MAY AFFECT YOUR COMPUTER EQUIPMENT, SOFTWARE, DATA OR OTHER PROPERTY ON ACCOUNT OF YOUR USE OF THESE SITES OR YOUR DOWNLOADING OF ANY MATERIAL FROM THESE SITES.
THIS IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL LOSSES AND DAMAGES OF ANY KIND (WHETHER DIRECT, INDIRECT, GENERAL, SPECIAL, CONSEQUENTIAL, INCIDENTAL, EXEMPLARY OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, LOSS OF DATA, INCOME OR PROFITS), WHETHER THE CLAIM IS BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR ANY OTHER LEGAL THEORY, EVEN IF AN AUTHORIZED REPRESENTATIVE OF WRIGHT OR ANOTHER RELEASED PARTY HAS BEEN ADVISED OF OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES, AND WITHOUT REGARD TO THE SUCCESS OR EFFECTIVENESS OF OTHER REMEDIES.
IF ANY PART OF THIS LIMITATION OF LIABILITY IS FOUND TO BE INVALID, ILLEGAL OR UNENFORCEABLE FOR ANY REASON, THEN THE AGGREGATE LIABILITY OF WRIGHT, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, LICENSORS AND SERVICE PROVIDERS, AND ITS AND THEIR RESPECTIVE SHAREHOLDERS, DIRECTORS, OFFICERS, EMPLOYEES AND AGENTS, UNDER SUCH CIRCUMSTANCES TO YOU OR ANY PERSON OR ENTITY CLAIMING THROUGH YOU FOR LIABILITIES THAT OTHERWISE WOULD HAVE BEEN LIMITED SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES. ACCORDINGLY, SOME OF THE THESE LIMITATIONS OF LIABILITY MAY NOT APPLY TO YOU.

Choice of Law, Jurisdiction and Venue
These Terms of Use and the relationship between you and Wright shall be governed by and construed in accordance with the federal laws of the United States of America and the internal laws of the State of Tennessee, U.S.A., excluding conflict of laws provisions that would indicate the application of the laws of any other jurisdiction. ANY LEGAL ACTION OR PROCEEDING RELATING TO YOUR ACCESS TO, OR USE OF, THESE SITES OR THESE TERMS OF USE SHALL BE INSTITUTED ONLY IN A STATE OR FEDERAL COURT LOCATED IN SHELBY COUNTY, TENNESSEE, U.S.A. YOU AND WRIGHT IRREVOCABLY AGREE TO SUBMIT TO THE JURISDICTION OF SUCH COURTS. You expressly waive any claim of improper venue and any claim that such courts are an inconvenient forum. Wright’s failure at any time to require performance of any provision of these Terms of Use or to exercise any right provided for herein shall not be deemed a waiver of such provision or such right. All waivers must be in writing and signed in ink by the party to be bound. Unless the written waiver contains an express statement to the contrary, no waiver of any breach of any provision of these Terms of Use or of any right provided for herein shall be construed as a waiver of any continuing or succeeding breach of such provision, a waiver of the provision itself, or a waiver of any right under these Terms of Use.
If any provision of these Terms of Use is held to be invalid or unenforceable by a court of competent jurisdiction, such invalidity or unenforceability shall not affect the validity or enforceability of the remaining provisions, and the court shall substitute for such provision the valid and enforceable provision that most closely approximates the intent and economic effect of such provision. The remaining provisions of these Terms of Use shall remain in full force and effect.
These Terms of Use set forth the entire understanding and agreement between us and supersede all prior understandings and agreements between you and Wright with respect to the subject matter hereof.

This Policy May Change
As we add new features and functionality to these Sites, we may need to update or revise this Policy. We reserve the right to do so, at any time and without prior notice, by posting the revised version on these Sites. These changes will be effective as of the date we post the revised version on these Sites. They will apply only to the personal information we collect after we have posted the revised version. Your use of these Sites following any such change constitutes your consent to the terms of the revised Policy. For this reason, it is important to review this Policy regularly. If we modify this Policy, we will provide a notice at the top of this Policy for at least thirty days after the new effective date.

You may access the current version of this Policy at any time by clicking on the link marked “Privacy Policy” at the bottom of each page of these Sites.

Wright’s Privacy Notices are part of this Policy.

Privacy requirements vary from country to country. To meet these requirements we may include certain “country-specific notices” as part of this Policy. What Personal Information Do We Collect When You Use Sites?
Information You Provide. We collect the personal information you knowingly provide (using your mouse and keyboard) when you use these Sites. The information we collect depends on how you use these Sites. For example:

If you search for a surgeon in your geographic area, we collect the contact information you submit.

If you apply for a job with Wright, we collect your contact information and any resume you upload.

If you contact us through these Sites to request additional information, we collect the information included in your request.

Information Sent to Us by Your Web Browser. We collect information that is sent to us automatically by your Web browser. This information typically includes your IP address, the name and version of your operating system, the name and version of your browser, the date and time of your visit, and the pages you visit. Please check your browser if you want to learn what information your browser sends or how to change your settings.

This information does not identify you personally. Generally, we use this information to improve these Sites and make them more compatible with the technology used by visitors. In most cases, we do not link the information sent by your browser to information that identifies you personally. However, there are some exceptions to this rule. For example, if you have created a user identity by signing up to use a password-protected area of Sites, Wright may link your IP address to information that identifies you personally. We may also review server logs — which contain visitors’ IP addresses — for security purposes, such as detecting intrusions into Wright’s network. If we suspect criminal activity, we may share server logs with the appropriate investigative authorities who could use that information to trace and identify individuals.

Cookies and Similar Technologies. We use “cookies” and similar Web technologies to collect information and support certain features of these Sites. A cookie is a piece of Web code that is used primarily for one or more of the following: analysis of Web site traffic and user behavior, application functionality, and data storage. We use two types of cookies: “session cookies” and “persistent cookies.”

We use session cookies to assign a randomly generated unique identification number to your computer. Assigning your computer a number permits us to follow you as you move from page to page. A session cookies expires after you close your browser.

We use session cookies to collect statistical information about the ways visitors use these Sites — which pages they visit, which links they use, and how long they stay on each page. We analyze this information (known as “clickstream data”) to better understand visitors’ interests and needs and to improve the content and functionality of these Sites. Session cookies do not identify you personally.

We use persistent cookies (cookies that do not expire when you close your browser) for several purposes. Like session cookies, they are used to assign a unique identifier to your computer, but because they are persistent, they permit us to recognize your computer each time you use it to access the Site. By using persistent cookies, we can collect and analyze clickstream data from more than one visit to the Site. Persistent cookies remain on your computer until you delete them or until they expire. Expiration durations vary and are set by Wright and/or third-party service providers.

Finally, both types of cookies (persistent and session) are occasionally used to facilitate the proper functioning of applications and features of these Sites.

If you do not wish to receive cookies, you may set your browser to reject cookies or to alert you when a cookie is placed on your computer. You may also delete cookies as soon as you leave these Sites. Although you are not required to accept cookies when you visit these Sites, if you set your browser to reject cookies, you will not be able to use all of the features and functionality of these Sites.

When you use these Sites or third-party sites to search for job openings or apply for a position, you may be asked to provide certain personal information, such as your name, address, telephone number, e-mail address, educational background and employment history. You may also send us your resume and other information relating to your job search or application. Please note that by submitting personal information to us through the careers area of one of these Sites or third party provided sites, you authorize us to transmit and store your information in a recruitment database. We may also use this information in contacting references you provide or to obtain a consumer report regarding your criminal record. If you are hired by one of us, the information you provide during the recruiting process will become part of Wright’s employee records and may be used to “populate” or “pre-fill” data fields on password-protected sites used for human resource purposes, such as employee benefit administration sites. The career areas of these Sites may be “powered” by a third-party service provider and additional Terms of Use and Privacy Policies may be applicable.
